ASUU GBEGE: Appellate Court To Hold Final Ruling On The Case of ASUU Against FG Today!

We bring you the latest gist on ASUU so far. Recall we informed you of the hearing of ASUU’s case by the Appellate Court on the 4th of October before the news of the issuance of a certificate of registration to CONUA sprang up.

Well, we have feedback from that news. As gathered from Vanguard News, the Appellate court came to a unanimous decision that consisted of a three-man panel of Justices to defer the hearing of ASUU’s case for another 24 hours. However, before deferring the hearing, the appellate court said it was to give the Academic Staff Union of Universities and the Federal Government an opportunity to have a rethink and meet at the negotiation table again with the aim of resolving the matter amicably and out-of-court.

Justice Georgewill Abraham, one of the Justices, implored the lawyer and counsel of the Federal Government and ASUU, respectively, Mr. James Igwe and Mr. Femi Falana to please convey the proceedings of the court to their clients. He added, “There is time for everything. Time for war and time for peace. As ministers in the temple of Justice, we want to see the two of you as Senior Advocates of Nigeria to encourage the amicable settlement of the issue”. The justice said he hopes to hear good news by Thursday and that the two parties involved should consider the future of the Nigerian students on hold because of their dispute.

Sha new tori wey dey reach us be that on the 7th of October, 2021, which is today, the Court of Appeal will give a final ruling on the case of ASUU against the NIC order. It seems Justice Abraham did not get the responses he wished for on Thursday.

Femi Falana, counsel to ASUU, emphasizes that it was the right of the Union to seek appeal as the order was unsatisfactory and against their struggle, and it would be a dangerous thing to deny the Union that. FG, however disagrees and urges the Appellate court to dismiss the appeal based on the grounds of incompetence and jurisdiction. FG’s lawyer, James Igwe, emphasizes that ASUU has been in contempt of court, not following NIC’s order up till date and that according to the Trade Dispute Act, their appeal was invalid.

Justice Barka Hamma, after hearing both sides on Thursday, declared that a final ruling on the case will be made today.
